1. About these Terms
These Terms of Service (the “Terms”) govern your access to and use of the Atlastic mobile application for iOS and Android (the “App”), the website atlastic.com (the “Site”), and the related travel-planning and booking services we provide (together, the “Service”).
The Service is operated by MajeStay Technologies Limited, a company registered at DIFC, Dubai, United Arab Emirates [exact DIFC office/unit to be confirmed] (“Atlastic”, “we”, “us”, or “our”). Atlastic is part of the MajeStay group of brands.
In these Terms, “you” means the person who accesses or uses the Service. Please read these Terms carefully. They include important provisions about how bookings work, how payments are processed, the limits of our AI concierge, and limitations on our liability.
These Terms work together with our Privacy Policy (atlastic.com/privacy) and our Account & Data Deletion page (atlastic.com/data-deletion), which are incorporated by reference. Those pages set out the GDPR legal bases for processing, our international-transfer safeguards, and our data-retention periods. Counsel to confirm the /privacy and /data-deletion pages are published and that they set out, consistent with the DIFC Data Protection Law (DIFC Law No. 5 of 2020), the legal bases for processing, our international-transfer safeguards, and our data-retention periods, before these Terms go live, since these Terms incorporate them by reference.
2. Acceptance of these Terms
By creating an account, downloading or using the App, browsing the Site, or making a booking through Atlastic, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.
When you book travel through Atlastic, you also agree to the terms, fare rules, and policies of the relevant travel supplier (see Section 8). Those supplier terms apply to your booking in addition to these Terms.
3. Eligibility
To use the Service and to make bookings, you must:
- be at least 16 (and you must be 18, or the age of legal majority where you live, to enter into a binding payment contract and make a booking) years old and able to form a legally binding contract;
- provide accurate, current, and complete information about yourself and any travelers you book for; and
- use the Service only for lawful, personal, non-commercial travel-planning and booking purposes.
The Service is not directed to children, and we do not knowingly collect personal data from children under the applicable age threshold. If you book on behalf of other travelers, you confirm you are authorized to share their details and to accept these Terms and the applicable supplier terms on their behalf.
4. The Service — what Atlastic does
Atlastic is a consumer travel app that helps you discover and book travel. Through the Service you can:
- Discover curated trips — browse curated daily trip ideas and inspiration.
- Get concierge guidance from Atlas — our in-app AI travel concierge, which suggests destinations, itineraries, and options based on your queries (see Section 7 for important limits).
- Book travel — flights, hotels and stays, activities, airport transfers, and curated multi-component packages, fulfilled by third-party travel suppliers (see Section 8).
- See honest, all-in pricing — prices shown at the point of booking are intended to be all-in, meaning applicable taxes and mandatory fees known at the time are included, with no hidden drip pricing. Some charges imposed directly by a supplier or destination at the point of travel (for example certain local taxes, resort fees, or incidentals collected on-site) may fall outside the price we display and will be your responsibility; where this applies we aim to disclose it before you book.
- Freeze your deal — for eligible offers, you can lock a displayed price for a limited window in exchange for a “Freeze-your-deal” fee (see Section 6).
Atlastic acts as a facilitator between you and travel suppliers. We are not the airline, hotel, activity operator, or transfer provider, and we do not ourselves provide the underlying travel services.
5. Your account
To book and to use certain features, you need an Atlastic account. You can register with your email or sign in using Google or Apple. When you use social sign-in, we receive basic profile information (such as your name, email, and avatar) from that provider, as described in our Privacy Policy.
You are responsible for:
- keeping your account credentials secure and not sharing them;
- all activity that occurs under your account; and
- the accuracy of the account, traveler, and contact details you provide (including names exactly as they appear on travel documents, dates of birth, and contact information), since errors can cause bookings to be rejected or to incur supplier change fees.
Notify us promptly at hello@atlastic.com (for security concerns, you may also contact privacy@atlastic.com) if you believe your account has been accessed without authorization. We may suspend or limit accounts as described in Section 14.
6. Pricing, the Freeze-your-deal fee, and changes
All-in pricing. We aim to show transparent, all-in prices as described in Section 4. Prices, availability, and offers can change quickly because they depend on live supplier inventory. A price is only guaranteed once your booking is confirmed (or, where you use Freeze-your-deal, for the duration and on the terms of that freeze). Counsel to confirm the App actually discloses on-site/supplier-imposed charges before booking, as promised in Section 4, to avoid a deceptive-practices exposure under applicable UAE/DIFC consumer-protection rules.
Freeze-your-deal. Where offered, Freeze-your-deal lets you lock a displayed price for a stated window in exchange for a fee. Key terms:
- The freeze fee and the freeze window are shown to you before you confirm the freeze.
- If you complete the booking within the window, the freeze fee is credited against the price of that booking (it comes off the booking total), as disclosed at the time.
- If you do not complete the booking within the window, the freeze expires, the locked price is no longer guaranteed, and the freeze fee is non-refundable and retained as the cost of the price lock, except where a refund is required by applicable law.
- A freeze locks the price only. It does not reserve inventory or guarantee that the underlying flight, stay, activity, or transfer will still be available when you complete the booking, unless we expressly state otherwise.
- Additional conditions: eligibility, the maximum freeze amount, the number of active freezes, and the eligible product types are as shown in the App at the time you place a freeze.
Errors. Despite our efforts, a price or description may occasionally be wrong due to a technical or supplier error. Where a clear error has occurred, we (or the supplier) may decline or cancel the affected booking and offer you the correct price or a full refund of amounts paid for that item, to the extent permitted by law.
7. Atlas AI concierge — important disclaimer
Atlas is an AI-powered concierge that generates travel suggestions, itineraries, and answers using a third-party large-language-model provider to process your queries. Please understand:
- Advisory only. Atlas provides suggestions and information to help you plan. It does not make decisions for you.
- You always book. Atlas never finalizes a booking on your behalf. Every booking requires you to review the details and confirm it yourself. There is no auto-booking, and no decision with legal or similarly significant effect is made about you by automated means alone.
- It can be wrong. AI-generated content may contain errors, omissions, or out-of-date information (for example on prices, availability, schedules, opening hours, visa or entry requirements, or local conditions). You should independently verify anything important before relying on it or booking.
- Not professional advice. Atlas does not provide professional travel, financial, legal, medical, immigration, or visa advice. For those matters, consult a qualified professional or the relevant official authority.
Your use of Atlas is at your own discretion, and your final booking decisions are your own.
8. Bookings — supplier terms and Atlastic as facilitator
When you book flights, stays, activities, transfers, or packages through Atlastic, the underlying travel service is provided by a third-party travel supplier (or by an aggregator/B2B distribution partner that contracts with those suppliers). Atlastic facilitates the booking; we are not the provider of the travel itself.
By confirming a booking you agree that:
- the booking is subject to the supplier’s own terms and conditions, fare rules, and cancellation, change, and refund policies, surfaced to you at the point of booking — please read them before you confirm;
- those supplier terms govern matters such as changes, cancellations, refunds, no-shows, baggage, check-in, schedule changes, and travel-document requirements, and may differ between suppliers and fare types;
- you are responsible for ensuring eligibility to travel, including valid passports, visas, entry permits, health/vaccination requirements, and that traveler names and details exactly match official documents; and
- where a supplier cancels, reschedules, or fails to deliver a service, your remedies are primarily against that supplier under their terms, although we will reasonably assist you in seeking a resolution.
Booking disputes and complaints. If something goes wrong with a booking, contact us first at hello@atlastic.com and we will reasonably assist in raising the matter with the relevant supplier. Counsel to add any mandatory consumer dispute-resolution or online dispute-resolution (ODR) references if EU/UK consumers are served; for UAE/DIFC consumers, complaints may also be raised through the applicable DIFC consumer channels.
Packages. A curated multi-component package may combine services from more than one supplier. Unless we expressly state that a package is sold as a single regulated travel package, each component remains subject to its own supplier’s terms. Counsel to confirm whether any offering constitutes a regulated “package” or “linked travel arrangement” under applicable consumer-protection law (e.g. EU/UK Package Travel rules, and any UAE/DIFC equivalents) and add any required disclosures, insolvency protection, and mandatory information.
9. Payments
Card payments via Stripe. Card payments are processed by Stripe, our PCI-compliant payment processor. Your card details are captured directly by Stripe. Atlastic does not store your full card number.
Cards charged directly — no in-app purchase. Because the bookings you make are real-world travel services, they are charged directly to your payment card and are not processed through Apple In-App Purchase or Google Play Billing. This is consistent with the app-store rules that exempt physical/real-world goods and services from in-app purchase.
Authorization. By confirming a booking or a Freeze-your-deal, you authorize us and Stripe to charge your payment method for the amounts shown (the booking total, any taxes and fees included in the all-in price, and any freeze fee). This may include a temporary pre-authorization or hold on your payment method. The final amount charged by your bank may differ slightly from the displayed amount due to your card issuer’s or bank’s currency conversion and any foreign-transaction fees, which are outside our control. You confirm you are authorized to use the payment method.
Currency, refunds, and chargebacks. The currency, any currency-conversion handling, and refunds are as displayed at booking and as governed by the applicable supplier’s policy (Section 8). Refunds, where due, are typically returned to your original payment method and may take time to process depending on the supplier and your bank. Counsel and owner to confirm display/handling of currency conversion and whether any Atlastic-level service or processing fee is charged. Initiating a chargeback for a valid charge instead of contacting us first may delay resolution; please reach out to support so we can help.
10. Acceptable use
When using the Service, you agree not to:
- use the Service for any unlawful, fraudulent, or harmful purpose, or to make speculative, false, or fraudulent bookings;
- resell, sublicense, or commercially exploit bookings or content except as expressly permitted;
- interfere with, disrupt, overload, probe, or attempt to gain unauthorized access to the Service, our systems, or other users’ accounts;
- scrape, harvest, or systematically extract content, pricing, or inventory, or use bots or automated means except as we expressly allow;
- misuse the Atlas concierge — for example by attempting to extract its underlying prompts or model, to generate unlawful or abusive content, or to overwhelm it; or
- upload or transmit content that is unlawful, infringing, deceptive, or that contains malware.
We may investigate and take action (including suspension or termination) for conduct that violates these Terms or harms the Service, other users, or our suppliers.
11. Intellectual property
The Service — including the Atlastic and Atlas names and logos, the App and Site, their design, text, graphics, curated content, and software — is owned by Atlastic or its licensors and is protected by intellectual-property laws. Trademarks, supplier content, and other third-party materials remain the property of their respective owners.
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the App and Site for their intended purpose of planning and booking your own travel, subject to these Terms. You may not copy, modify, distribute, sell, reverse-engineer, or create derivative works from the Service except as permitted by law or with our prior written consent.
Your content and queries. You retain rights in the content and queries you submit. You grant us a license to use, process, and share that content only as needed to operate the Service and fulfill your requests — including sending your search queries to our AI provider so it can answer them, and sending your booking details to suppliers to complete your booking — as described in our Privacy Policy. As drafted, no model-improvement or model-training use of user queries is claimed: queries sent to our AI provider are processed only to answer them, are not used to train the provider’s models, and are held under a no-training, short-retention configuration and then deleted. If this ever changes, this license and the Privacy Policy must both be updated to say so.
12. Disclaimers
The Service is provided “as is” and “as available”, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that content (including AI-generated content and supplier information such as prices, availability, and descriptions) will always be accurate, complete, or current.
Atlastic acts as a facilitator and does not provide the underlying travel services. We are not responsible for the acts, omissions, errors, or failures of travel suppliers, including cancellations, schedule changes, overbooking, service quality, or safety, except as required by applicable law.
Nothing in these Terms excludes or limits any rights or protections you have under mandatory consumer-protection laws that cannot be waived, including any non-excludable statutory guarantees or remedies that apply to you.
13. Limitation of liability and indemnity
Limitation of liability. To the fullest extent permitted by law, Atlastic and its affiliates, officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost bookings, or loss of data, arising out of or relating to your use of the Service.
To the fullest extent permitted by law, our total aggregate liability to you for any claim arising out of or relating to the Service or a booking will not exceed the total Atlastic service and freeze fees you paid to us for the affected booking in the three (3) months before the event giving rise to the claim.
These limitations do not apply to liability that cannot be excluded or limited under applicable law (such as for death or personal injury caused by negligence, fraud, or non-excludable consumer rights).
Indemnity. To the extent permitted by law, you agree to indemnify and hold Atlastic harmless from claims, losses, and reasonable costs arising from your breach of these Terms, your misuse of the Service, your violation of a supplier’s terms, or your violation of any law or the rights of a third party.
14. Suspension, termination, and account deletion
By you. You may stop using the Service at any time. You can delete your account in-app at Settings → Delete Account, or request deletion without the App by emailing privacy@atlastic.com or using the request method on atlastic.com/data-deletion.
By us. We may suspend, limit, or terminate your access if you breach these Terms, misuse the Service, or where required to protect the Service, our users, or suppliers, or to comply with law.
What happens on deletion. When you delete your account, we delete or anonymize your personal profile data. However, certain records — including completed booking, payment, tax, and anti-fraud records — are retained where we are required to keep them by law or by our obligations to suppliers and payment partners. We aim to process deletion requests within up to 30 days subject to confirmation of the backend-guaranteed maximum and any reversible grace window, and we retain the legally required records for the minimum period required by applicable UAE/DIFC law (at least 5 years for financial and tax records). Full details of what is deleted versus retained are on our Account & Data Deletion page and in our Privacy Policy.
Sections that by their nature should survive termination — including payment obligations, the “Your content and queries” license, intellectual property, disclaimers, limitation of liability, indemnity, third-party-beneficiary rights, and governing law — will continue to apply.
15. Privacy and your data rights
Our Privacy Policy (atlastic.com/privacy) explains what personal data we collect (such as your email, name, optional phone number, date of birth and traveler details for bookings, booking/travel history, and the search queries you send to Atlas), the legal bases on which we process it, how we transfer it internationally and the safeguards we use, how long we keep it, and the third parties that help us run the Service — including Stripe (payments), travel suppliers/aggregators (to fulfill bookings), Google/Apple (sign-in), Firebase/Google (crash diagnostics only), AWS (hosting and email), and our AI model provider (to process concierge queries).
We do not sell or share your personal data for cross-context behavioral advertising; all the recipients above act as our service providers/processors.
Depending on where you live, you may have rights to access, correct, delete, port, restrict, or object to the processing of your personal data, including rights under the GDPR / UK GDPR (EU/UK) and the CCPA/CPRA (California), the right to non-discrimination for exercising your rights, and the ability to use an authorized agent where the law allows. See the Privacy Policy for how to exercise these rights.
16. Electronic communications
By creating an account or making a booking, you consent to receive communications from us electronically — including confirmations, receipts, service notices, and legal notices — by email or in-app message, and you agree that electronic agreements, notices, and records satisfy any legal requirement that such communications be in writing. You may withdraw consent to non-essential electronic communications, but we may still send communications necessary to provide the Service.
17. Apple App Store and Google Play
If you download the App from the Apple App Store, the following additional terms apply, and you acknowledge and agree that:
- these Terms are between you and Atlastic only, and not with Apple; Atlastic, not Apple, is solely responsible for the App and its content;
- Apple has no obligation to provide maintenance or support for the App;
- in the event the App fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App;
- Apple is not responsible for addressing any claims by you or a third party relating to the App, including product-liability, legal/regulatory, or consumer-protection claims, or any claim that the App infringes intellectual-property rights;
- you represent that you are not located in a country subject to a U.S. Government embargo or designated a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties; and
- Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce them against you.
If you download the App from Google Play, your use is also subject to the Google Play Terms of Service and the applicable Google Play Business and Program Policies.
18. Third-party beneficiaries
Except as expressly stated (including Apple’s rights in Section 17), these Terms do not create any third-party beneficiary rights. Where relevant, the disclaimers and limitations of liability in Sections 12 and 13 are intended to benefit, and may be relied upon by, Atlastic’s travel suppliers, Stripe, and Google/Apple.
19. Force majeure
We are not liable for any failure or delay in performing our obligations to the extent caused by events beyond our reasonable control, including acts of God, natural disasters, severe weather, fire, flood, epidemic or pandemic, war, terrorism, civil unrest, strikes or labor disputes, government action or travel restrictions, failures of airlines, hotels, or other suppliers, utility or telecommunications failures, or internet or hosting outages. This does not affect any non-excludable consumer rights or supplier obligations that apply to your booking.
20. Changes to the Service and to these Terms
We may update, add to, or discontinue parts of the Service over time. We may also update these Terms — for example to reflect new features, legal requirements, or supplier or payment changes. When we make material changes, we will update the “Last updated” date and, where appropriate, notify you in the App or by email. Changes take effect when posted (or on a stated later date). Your continued use of the Service after changes take effect means you accept the updated Terms; if you do not agree, please stop using the Service and you may delete your account.
21. Governing law and dispute resolution
These Terms, and any dispute arising out of or relating to them or to the Service, are governed by the laws of the Dubai International Financial Centre (DIFC), Dubai, United Arab Emirates, without regard to conflict-of-laws rules.
The courts (or dispute-resolution forum) of the DIFC Courts (Dubai) will have exclusive jurisdiction, except where mandatory consumer-protection law gives you the right to bring proceedings in your place of residence.
Counsel to confirm whether to include an arbitration clause, class-action waiver, and/or an informal dispute-resolution (notice and good-faith negotiation) step, and to tailor this section to the DIFC Courts forum and applicable consumer-protection rules.
22. General
- Entire agreement. These Terms, together with the Privacy Policy, the Account & Data Deletion page, and any applicable supplier terms, are the entire agreement between you and Atlastic regarding the Service.
- Severability. If any provision is found unenforceable, the rest of the Terms remain in effect.
- No waiver. Our failure to enforce a provision is not a waiver of it.
- Assignment. You may not assign these Terms without our consent; we may assign them to an affiliate or successor (for example, within the MajeStay group).
- Notices to Atlastic. Legal notices to Atlastic must be sent to legal@atlastic.com and, where formal service is required, to MajeStay Technologies Limited, DIFC, Dubai, United Arab Emirates [exact DIFC office/unit to be confirmed].
- Language. These Terms are provided in English, which is the governing language; any translation is provided for convenience only and the English version prevails in the event of a conflict.
- Availability. The Service may not be available in all countries or app stores. Counsel and owner to confirm the countries and app stores where the Service is offered.
